10A. Platform Purpose & PHIPA Disclaimer
GoJumbo is not a Practice Management System (PMS) and is not intended to store, process, or manage Personal Health Information (PHI) as defined under Ontario’s Personal Health Information Protection Act (PHIPA) or any comparable privacy legislation.
GoJumbo is designed solely as a communication and marketing automation platform to support general business and appointment-related messaging. Clinics and their authorized users are strictly prohibited from entering, uploading, or transmitting any information that qualifies as PHI (such as treatment notes, health histories, medical conditions, or diagnostic data).
By using GoJumbo, you acknowledge and agree that:
GoJumbo does not assume responsibility or liability for any PHI that users or clinics may inadvertently or intentionally input into the platform.
Each clinic or user is solely responsible for ensuring their compliance with all applicable privacy and health data protection laws.
You agree to indemnify and hold harmless GoJumbo Digital Solutions, its affiliates, officers, and employees from and against any claims, liabilities, damages, losses, or expenses arising out of or related to any unauthorized entry or misuse of PHI within the platform.
GoJumbo provides no warranty that the platform is compliant with PHIPA or other health information privacy laws for clinical record-keeping or patient management purposes. Users must not use GoJumbo as a substitute for a PHIPA-compliant PMS or electronic health record (EHR) system.
11.Limitation of Liability
To the fullest extent permitted by law, GoJumbo (and its officers, directors, employees, contractors) will not be liable for any indirect, incidental, special, punitive, or consequential damages (lost profits, data, business) arising from or in connection with your use of the Website, even if advised of the possibility. Our total liability is limited to CAD $100 or the lowest amount permitted by law, whichever is greater.
12.Termination & Suspension
We may suspend or terminate your access at any time for violation of these Terms or other reasons, without notice or liability to you. Upon termination, your rights under these Terms cease immediately. We may remove or delete your content and data.
13.Governing Law & Jurisdiction
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Disputes will be resolved in Ontario courts.
14.Notices
We may provide notices by email or via the Website. Notices to you shall be sent to the email on file. Notices deemed received upon delivery or 3 business days after mailing.
15.Severability & Waiver
If a provision is held invalid, the remainder of these Terms remains in effect. Failure to enforce a right is not a waiver of that right.

These Terms, together with the Privacy Policy and any disclaimers or notices, constitute the entire agreement between you and GoJumbo regarding your use of this Website & supersede prior agreements.
