1. Agreement to Terms
By accessing or using GoJumbo's services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Description of Services
GoJumbo provides AI-powered virtual assistant and lead capture services for local businesses, delivered through SMS, voice, messaging platforms, and other channels. Services are provided on a monthly subscription basis.
3. Client Responsibilities
- You are responsible for obtaining all necessary consents from your customers before we contact them on your behalf.
- You must comply with all applicable Canadian laws, including CASL, PIPEDA, and provincial privacy laws.
- You must not use our services to send unsolicited messages or engage in deceptive practices.
- You are responsible for the accuracy of all information you provide to us.
4. Subscription and Billing
Services are billed monthly in Canadian dollars (CAD). Subscriptions renew automatically unless cancelled before the next billing cycle. No refunds are provided for partial months. Prices may change with 30 days notice.
5. Acceptable Use
You may not use GoJumbo services to:
- Send spam, phishing messages, or illegal content
- Harass, threaten, or abuse any person
- Violate any applicable laws or regulations
- Impersonate any person or entity
- Collect personal information without proper consent
6. Data and Privacy
GoJumbo collects and processes data as described in our Privacy Policy. Lead data captured through our services is stored securely and accessible only to you and GoJumbo staff. We do not sell your data or your customers' data to third parties.
7. Service Availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (e.g., Twilio, Meta, Google), or force majeure events may affect service availability. We are not liable for losses resulting from downtime.
8. Limitation of Liability
GoJumbo's liability is limited to the amount paid in the month the issue occurred. We are not liable for indirect, incidental, or consequential damages. Our AI agents may make errors — we strongly recommend human review of all lead data before follow-up.
9. Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. To cancel, contact us at info@gojumbo.ca.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
